These Terms of Service govern your use of CuePal, operated by CuePal Inc., a company registered in British Columbia, Canada. By creating an account or using the CuePal app or website, you agree to these terms. If you do not agree, do not use CuePal.

1. Acceptance of Terms

By downloading, installing, or using the CuePal mobile application or website, you confirm that you are at least 13 years of age (or 16 in the EEA/UK), that you have read and understood these Terms, and that you agree to be bound by them. If you are between 13 and 17, you confirm that you have obtained parental or guardian consent.

2. Description of Service

CuePal is a snooker and billiards platform that provides player ratings, tournament management, club tools, practice routines, and community features. The platform includes:

• CuePal Free: Core features available to all registered users, including a public player profile, CuePal Global Rating (CGR), match logging, and access to select practice routines
• CuePal Pro: A paid subscription tier that unlocks additional features including AI Coach, full access to all practice routines, custom routine creation, and match and practice analysis

Feature availability may change over time. We will provide reasonable notice of any material reductions to features included in an active Pro subscription.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information when registering and to keep it up to date. You may not create more than one account, impersonate another person, or transfer your account to anyone else. We reserve the right to suspend or terminate accounts that violate these Terms.

4. CuePal Pro Subscription

4.1 Billing

CuePal Pro is available on a monthly or 6-month subscription basis. Pricing is displayed in the app at the time of purchase and may vary by region. All billing is processed by Apple (App Store) or Google (Google Play) on our behalf. CuePal Inc. does not store your payment card details.

4.2 Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. Your Apple ID or Google account will be charged for renewal within 24 hours prior to the end of the current period.

4.3 Cancellation

You may cancel your subscription at any time through your device's App Store or Google Play subscription settings. Cancellation takes effect at the end of the current billing period. You will retain access to Pro features until that date.

4.4 Refunds

All purchases are processed through Apple or Google. Refund requests are subject to their respective refund policies. CuePal Inc. does not issue refunds directly. To request a refund, visit:

4.5 Price Changes

We may change subscription pricing with reasonable advance notice. Continued use of CuePal Pro after a price change takes effect constitutes acceptance of the new price.

5. The CuePal Global Rating (CGR)

The CGR is an algorithmic rating system designed to reflect a player's skill level based on match results submitted through the platform. By using CuePal, you acknowledge that:

• Your CGR, match history, and ranking position are visible to other registered users
• The CGR is calculated automatically and is not a guarantee of absolute accuracy
• Historical achievements you voluntarily submit are taken in good faith but are not independently verified
• You may contact us at contact@cuepal.co to dispute a CGR calculation you believe is based on incorrect data

We do not use your CGR data for advertising or commercial profiling.

6. User Conduct

You agree not to use CuePal to:

• Submit false or manipulated match results
• Harass, abuse, or harm other users
• Attempt to reverse-engineer, scrape, or exploit the platform
• Violate any applicable law or regulation
• Create fake accounts or manipulate rankings

We reserve the right to remove content, suspend accounts, or restrict access for violations of these rules, without prior notice where necessary to protect the platform or its users.

7. User-Generated Content

By submitting content to CuePal (including match results, profile information, and practice logs), you grant CuePal Inc. a non-exclusive, royalty-free license to use, store, and display that content for the purpose of operating and improving the platform. You retain ownership of your content. You are responsible for ensuring that anything you submit does not infringe the rights of any third party.

8. Intellectual Property

All CuePal branding, software, design, content, and the CGR methodology are the property of CuePal Inc. and are protected by applicable intellectual property laws. You may not copy, distribute, or create derivative works from any part of the platform without our written permission.

9. Third-Party Services

CuePal integrates with or links to third-party services including Apple, Google, and payment processors. These services have their own terms and privacy policies. CuePal Inc. is not responsible for the practices of any third-party service.

10. Disclaimers

CuePal is provided on an "as is" and "as available" basis. We do not warrant that the platform will be uninterrupted, error-free, or free of harmful components. We make no warranties, express or implied, regarding the accuracy of CGR calculations or ranking positions.

11. Limitation of Liability

To the maximum extent permitted by applicable law, CuePal Inc. and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including but not limited to loss of data, loss of revenue, or reputational harm. Our total liability to you for any claim arising from these Terms or your use of CuePal will not exceed the amount you paid to CuePal Inc. in the 12 months preceding the claim.

12. Termination

We may suspend or terminate your account at any time for violation of these Terms, for fraudulent activity, or for extended inactivity, with or without notice. You may delete your account at any time through the app settings. Upon termination, your right to use CuePal ceases immediately. Sections 5, 7, 8, 11, and 13 survive termination.

13. Governing Law and Disputes

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Any disputes arising from these Terms or your use of CuePal will be subject to the exclusive jurisdiction of the courts of British Columbia, Canada.

14. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you via email or an in-app notice and update the "Last updated" date above. Your continued use of CuePal after the effective date of revised Terms constitutes your acceptance.
